Reese Witherspoon listed “irreconcilable differences” as the reason for divorcing Jim Toth, according to court documents filed on Saturday in the Circuit Court of Davidson County, Tennessee, People reported.

The divorce was announced in a joint statement issued last Friday from Witherspoon and CAA talent agency, which represents her. The announcement comes just days before what would have been Witherspoon’s and Toth’s twelfth anniversary.

“It is with a great deal of care and consideration that we have made the difficult decision to divorce,” Witherspoon said in the announcement. “We have enjoyed so many wonderful years together and are moving forward with deep love, kindness and mutual respect for everything we have created together.”

“Our biggest priority is our son and our entire family as we navigate this next chapter,” Witherspoon added. “These matters are never easy and are extremely personal. We truly appreciate everyone’s respect for our family’s privacy at this time.”

Who will get custody of their 10-year-old son?

According to the court filing, Witherspoon asked the court to designate joint custody of their 10-year-old son, Tennessee James, to both her and Toth.

A source told People that despite the divorce, the two “really are the best of friends.”

“This is such an amicable decision,” the insider said. “They are so committed to co-parenting together.”

“They are invested in their whole family and making this as smooth as possible for everyone,” the source added.

Did Reese Witherspoon have a prenup

According to the documents, which list the filing date as the date of their separation, the couple does have a prenuptial agreement in place.

The document shows Witherspoon and Toth had entered a premarital agreement in California on March 24, 2011, just a few days before their wedding.

According to the court filing, the prenup is “valid and enforceable,” Today reported. Why is that important? Because Reese is one of the richest actresses in Hollywood!

Reese Witherspoon’s net worth is estimated at around $400 million, according to Forbes.

However, Marca reports that the salaries Witherspoon has earned throughout her career acting in successful films were not enough to help her reach that impressive number. Instead, they say the bulk of her wealth came from a production company that she founded in 2012, which was acquired by Blackstone in 2021.

Because the founding of that production company and its acquisition occurred during the time the couple was married, it is unclear at this time whether Toth will be entitled to a share of that income.
