Trump’s indictment & arrest: The latest updates

On Tuesday, March 4, 2023, former President Donald Trump arrived in New York City, where he was expected to turn himself in and surrender to the District Attorney’s Office for arraignment in a Manhattan courtroom this afternoon, CNN reported.

Trump is expected to be charged with 34 felony counts related to business fraud; however, he will not be put into handcuffs, subjected to a mugshot, or placed in a jail cell, as the DA’s office – in consultation with the Secret Service and New York City court officials – agreed it would be unnecessary, Yahoo News reported.

Before entering the court, Trump plans to deliver brief comments consisting of one short line.

Inside the court, news outlets will not be allowed to broadcast the arrangement, according to a ruling by a judge on Monday night who rejected a request by several media organizations.

About the charges: DA elevated misdemeanor charges to felony

Because grand jury records are sealed and secret, the exact charges will not be known until the indictment is unsealed, which is expected to happen at the arraignment hearing that is scheduled at 2:15 PM EDT. Judge Juan Merchan, who presided over the criminal tax fraud case against Trump’s company, will also preside over this arraignment.

The charge of falsification of business records can be prosecuted in New York state as a misdemeanor. However, DA Bragg’s office elevated the charges to Class E felonies — the lowest level of felonies in the New York state penal code — on grounds the conduct was intended to conceal another underlying crime, according to a source.

Trump expected to make evening speech

After the arraignment hearing, former President Donald Trump is expected to fly back home to Florida this evening, where he plans to deliver a speech.
