British model Kate Moss is set to appear on Wednesday as a witness in the $100 million defamation trial of Johnny Depp and Amber Heard after giving his attorneys a chance to quell rumors about their relationship.

After much speculation, it has been confirmed that model Kate Moss will be called to the stand this week, likely appearing via a video link on Wednesday in a Fairfax, Virginia courtroom, sources confirmed to the New York Post.

Many speculate that the appearance of Moss could be bad news for Heard, who dropped the supermodel’s name during testimony on May 5, which now gives Depp’s attorneys a chance to refute rumors about his ex-girlfriend, the Daily Mail reported.

Heard had previously claimed in a UK courtroom that she was told by two people that he had pushed the model down the stairs during the time Depp dated Moss between 1994-1997.

Had Heard not mentioned Moss during testimony, Depp’s attorneys would not likely have been able to bring her on as a witness.

The rumored staircase incident wasn’t related to a specific accusation in the Virginia case, a legal expert said. But Heard’s mention of the model paved the way for Depp’s team to call her to testify.

Because Heard made the allegations of Depp pushing Moss down the stairs while testifying in a courtroom, it gives Depp’s attorneys legal ground to call Moss as a witness to discuss the rumor, which sources have said is not true.

“That’s one mistake that [Heard] made, was bringing up Kate Moss, which potentially opened the door to [Depp’s team] bringing [Moss] on as an impeachment witness,” according to California entertainment lawyer Mitra Ahouraian. “And Moss “saying ‘This never happened.'”

Heard brought up Moss while testifying on May 5 while recounting a March 2015 fight in which she punched Depp in the face out of fear he was going to shove her sister Whitney down a staircase, according to the Post.

Moss expected to support Depp, deny Heard allegations

When Heard made the allegation in court, Depp’s legal team was seen fist-bumping and celebrating.

According to sources, Moss has always been supportive of Depp.

“Amber mentioned an ex of Johnny’s that clearly she felt was not supportive of him,” a source close to Depp told the Post at the time. “Which couldn’t be further from the truth.”
